If you are a green card holder and you have been placed in Immigration Court because of a criminal conviction, you may be eligible for Cancellation of Removal which would allow you to keep your green card.

 

In general, to qualify for cancellation of removal, you must:

 

  • have been a green card holder for at least 5 years;
  • have continuously resided in the United States for 7 years after being admitted in any status before the “stop-time rule” is triggered;
  • have not been convicted of an aggravated felony;
  • have not received cancellation of removal in the past or a 212(c) waiver; and 
  • you are deserving, as a matter of discretion, for your application to be approved (the judge will weigh the positive and negative factors in your case).
